These Terms of Use govern your access to and use of the Growy service operated by Passionate Income LLC, including Growy's websites, applications, APIs, AI-assisted content tools, connected account features, publishing workflows, analytics tools, and paid subscription features.
By creating an account, accessing Growy, or using any part of the service, you agree to these Terms. If you use Growy on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use Growy. Questions can be sent to support@growyapp.com.
1. Eligibility and Accounts
You may use Growy only if you can form a binding contract under applicable law, are at least 18 years old, and are not barred from using the service under applicable laws or sanctions rules.
You are responsible for maintaining the confidentiality of your login credentials, for all activity that occurs under your account, and for keeping your account information accurate and current.
2. The Service
Growy is an AI-assisted content operations platform. Depending on the features you use, Growy may help you create drafts, generate text and images, upload media, manage page settings, schedule publishing jobs, publish to connected platforms, and review analytics pulled from those platforms.
We may add, modify, suspend, or remove features from time to time. We do not promise that every feature will always be available, uninterrupted, or error-free.
3. Your Content and Inputs
You keep ownership of the content, prompts, media, account materials, and other information you submit to Growy, subject to the rights you grant us in these Terms.
You grant Growy a non-exclusive, worldwide, limited license to host, store, reproduce, modify, transmit, display, and process your content only as needed to operate, secure, maintain, and improve the service, including to generate requested outputs, store drafts, publish at your direction, and provide support.
You represent that you have all rights, permissions, and authority necessary to upload, use, publish, and authorize Growy to process your content and connected accounts.
4. AI Features and Output Responsibility
Growy uses third-party AI systems to help generate topics, captions, slides, threads, audience descriptions, images, and other content. AI output may be inaccurate, incomplete, offensive, repetitive, or not fit for your use case.
You are solely responsible for reviewing and approving AI-generated output before publishing, sharing, or relying on it. This is especially important for factual statements, regulated content, endorsements, legal claims, health claims, financial claims, copyright-sensitive material, or platform-specific policy issues.
Growy does not guarantee the originality, accuracy, legality, platform compliance, commercial suitability, or performance of AI-generated content.
5. Connected Platforms
If you connect an Instagram or other third-party account, you authorize Growy to act on your instructions within the permissions granted by that connection.
You remain responsible for your relationship with those platforms, compliance with their terms and policies, and any content posted to or data retrieved from those platforms through Growy.
If a connected platform changes its API, permissions model, rate limits, or enforcement posture, certain Growy features may stop working or may be limited without liability to Growy.
6. Fees, Subscriptions, Trials, and Billing
Some Growy features require a paid subscription. Subscription access may be scoped per page or workspace, as reflected in the product experience.
Trials, promotional offers, post quotas, revision limits, pricing, and available billing intervals may vary by plan and may change over time for future purchases or renewals as permitted by law.
If you purchase a subscription, you authorize the applicable billing provider to charge the payment method associated with your subscription for recurring fees, taxes, and any other charges you authorize.
Unless otherwise stated at purchase, subscriptions automatically renew for the selected billing interval until canceled. If the billing provider or plan allows it, cancellation generally takes effect at the end of the current billing period.
If you are dissatisfied, you may request a refund within 3 days after your first charge. After that 3-day window, charges are generally non-refundable except where required by law.
Growy does not store full payment card numbers in the current codebase. Payment processing is handled by the external billing provider.
7. Acceptable Use
You may not use Growy, or permit others to use Growy, to do any of the following:
- Violate the law, infringe intellectual property or privacy rights, or breach another person's contractual or platform rights.
- Upload or publish unlawful, defamatory, harassing, hateful, fraudulent, deceptive, or malicious content.
- Attempt to gain unauthorized access to accounts, pages, systems, tokens, storage, models, or infrastructure.
- Interfere with the service, evade quotas or rate limits, scrape the service, reverse engineer restricted parts of the product, or use automated means to overload the system.
- Use Growy to create or distribute spam, impersonation content, malware, credential-harvesting material, or other abusive content.
- Use AI features in a way that violates the rules of the underlying model providers or connected platforms.
- Upload, generate, publish, or schedule music, sounds, or other media unless you have the necessary rights and the use is permitted for the destination platform. If Growy later supports official platform music libraries, you may use that music only within the scope of the license and platform rules attached to that library.
8. Suspension and Termination
We may suspend or terminate access to Growy, in whole or in part, if we reasonably believe you violated these Terms, created risk for the service or others, failed to pay amounts due, or if continued access would expose Growy to legal or operational harm.
You may stop using the service at any time. Growy currently provides page deletion and account deletion tools, though some retained records may remain where required for legal, security, tax, accounting, or contractual reasons.
9. Intellectual Property
Growy and its underlying software, design, branding, interfaces, documentation, and service content are owned by Growy or its licensors and are protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms, Growy reserves all rights, title, and interest in and to the service.
10. Feedback
If you send Growy suggestions, ideas, bug reports, or other feedback, you grant Growy a non-exclusive, worldwide, royalty-free, perpetual license to use that feedback to improve the service without restriction or compensation, so long as doing so does not require us to publicly identify you.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. GROWY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, Growy does not warrant that the service will be uninterrupted, secure, accurate, complete, timely, or free from harmful code, data loss, model errors, platform API changes, or third-party outages.
12. Limitation of Liability
To the fullest extent permitted by law, Growy and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, or content, arising out of or related to the service or these Terms.
To the fullest extent permitted by law, the total aggregate liability of Growy and its affiliates, licensors, and service providers for all claims arising out of or relating to the service or these Terms will not exceed the greater of the amounts you paid Growy for the service in the twelve months before the event giving rise to the claim or one hundred U.S. dollars (US$100).
Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnity
You will defend, indemnify, and hold harmless Growy and its affiliates, officers, directors, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your content, your use of the service, your connected accounts, or your violation of these Terms or applicable law.
14. Governing Law and Venue
These Terms are governed by the laws of Wyoming, USA, without regard to conflict-of-laws rules. To the extent a dispute may be brought in court, you and Growy agree to the exclusive jurisdiction of the state or federal courts located in Wyoming, except where applicable law provides otherwise.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date and may provide additional notice where required. Your continued use of Growy after the updated Terms become effective means you accept the revised Terms.
